Why Do You Need Title Insurance? — Lamens Terms

Why do you need title insurance? It’s the second most asked question in our office. The most asked question is – When do we get the keys? That was discussed in an earlier post here at TPREG.com.

Let’s start with the official definition for title insurance. From www.ctic.com, we have the following:

Title Insurance – Assurance of indemnification for loss occasioned by defects in the title to real property or to an interest therein which is insured.

Huh? Clear as mud, right?

Let’s get away from the legalese and talk in plain English. Title insurance is an insurance policy. It is different from other forms of insurance. Automobile insurance, for example, protects you from some “future” event, be it a fender bender or theft of the car. Title Insurance also protects you from some future event, like a claim or loss due to a title issue. The difference is that these issues were caused by a past event. The event causing the claim occurred prior to your purchase of the property.

Another big difference from other insurances you may carry is that title insurance on your real property is a one-time premium. There is no annual premium to keep the policy in effect. It covers your real property as long as you or your heirs own retain an interest in the property.

Let’s go back to our original question. Why do you need title insurance? The easiest answer is to protect what is probably the biggest and most important investment you will ever make.

What sorts of issues are covered? Here’s a short list of some of the more common risks that can cause a loss or encumbrance of title:

False Impersonation

Forged Deeds

Fraud

Undisclosed or missing heirs

Deeds by persons purported to be single when actually married

Liens for unpaid inheritance, income, or estate taxes

What happens if any of these defects or hidden risks are discovered? Title insurance covers the cost of defending any lawsuit against your title as insured. It will also rectify any issues discovered, or pay any losses for the insured. It is important to understand that these claims can arise from a past event that could not be discovered in a public record search. Therein (oops, legal word) lies the true value of title insurance.

So the answer is simple. You need title insurance because it provides peace of mind in knowing that the property you are buying and the investment you are making is a safe one.

My favorite quote from this article is when Bill says “Why do you need title insurance? The easiest answer is to protect what is probably the biggest and most important investment you will ever make.” Readers of this blog it’s really that simple hopefully you won’t have any issues but you will be extremely thankful when the Title Insurance is there to protect you and your biggest asset.

In the new world of Green Bay Foreclosures and Green Bay Short Sales it’s extremely important to even add some extra coverage called a GAP Endorsement. Gap Endorsement: Gives coverage against intervening adverse matters affecting title which are recorded or filed between the date of commitment and the recording of the documents. This extra coverage is reasonable for covering what it does. It’s a common misconception for a buyer of the home to think that they are covered under title insurance from the moment they have an accepted offer. Well there not covered unless you have gap endorsement.

Short sales, however, are not for the faint-hearted. While there is a possibility for a good price, there is also a good chance that the deal will not go through. Many cooks are involved in this stew. The buyer must negotiate the price with both the seller and the seller’s lender. At the same time, the seller must negotiate with the lender on the terms for forgiving the amount still owed on the mortgage. Meanwhile the bank is negotiating fees for lawyers and brokers. The process can take six to nine months.

For Sharay Hayes, who owns a four-story town house on Strivers Row in Harlem, a short sale may be the only way to avoid bankruptcy. Mr. Hayes inherited a share of the house, where he has lived since he was 3, from his grandfather in 2001. Over the years, he took out several mortgages to buy out six relatives and to restore the house’s 19th-century grandeur while renovating it with 21st-century finishes and luxuries like a steam room and a whirlpool tub.

Until late last year, he kept up with payments on the $1.8 million he owes on the house. But his “entire portfolio of income earning was in real estate,” he said, namely rental properties in Ohio. Those investments went south when the auto plant that employed most of his tenants was shuttered about a year ago; he also is on the verge of losing these properties.

Even Green Bay Short Sales can be roller coaster ride

This article from the New York Times really sheds some clear light on the subject of Short Sales in the Real Estate marketplace as a whole. Clearly throughout this article they do a good job of painting reality in my opinion. Throughout the last five years of my Green Bay Real Estate career I’ve handled numerous Green Bay Short Sales. Over the course of time I’ve realized that if you are sincerely wanting to get a Green Bay Short Sale approved you better have an extremely aggressive and knowledgeable agent on the listing side. The Green Bay Real Estate agent you hire to handle your Green Bay Short Sale needs to be a true pit bull and relentless on follow up. The major problems that occur with short sales in our neck of the woods is the communication problems over time. Just like the New York Times referenced this process can take 6 to 9 months and I’ve personally seen it longer.

Considering how much of a control freak I am the short sale process sometimes drives me crazy. No matter sometimes how hard you diligently and aggressively pursue something it never happens at the pace you would like. How does this effect Green Bay New Construction

As you can see we are on a 15 month low for the Home Builder Index in July via the article below from one my favorite blog sites the Real Estate Bloggers.. What effect does this have on the Green Bay New Construction Real Estate Market? It has a profound impact on the types of Green Bay New Construction homes that are being constructed. In the Green Bay New Construction Market we are still seeing speculative building in under $200,000 market.

In this article they talk about the tax credit and the effects of it on the Green Bay New Construction Housing Market. With my experience with working with my builder AAA Plus Construction Shannon Kane over the last three years we are seeing there is still some demand in the New Construction Market but it’s really in specific niches and areas. Shannon from AAA Plus Construction used to typically build in the +$200,000 plus range but we understood that if we wanted to keep both of our companies busy we would need to alter our strategy and cater to a different market.

Striving in a difficult Green Bay New Construction Market

With that different transition in the Green Bay New Construction Market we’ve not only been able to survive but we are starting to thrive. Even when markets are down if you look hard enough to find a niche that is profitable you can even grow in a downward market.

Nationally 14 out of a hundred home builders surveyed by NAHB think that the new home market is doing okay. My question is, what do that 14 percent of homebuilders know or do they need to be drug tested?

But to be honest, there is some logic to the survey. After the expiration of the new home buyer tax credit, demand in the parts of the country that has lower cost housing has fallen off the cliff. So builders in the South and the West both saw their confidence numbers drop 5 points each. Meanwhile in the Northeast home builders saw their confidence rise as the tax credit was not as crucial to getting deals done up there due to the higher housing prices.

However, the industry is still in a bad place. With historically low interest rates

builders should be building like crazy and buyers should be chomping at the bit to get into a home at these low rates. But with the foreclosures working their way through the system, the economy in the pits, and economic confidence at it’s bottom, no one is thinking of buying new homes right now.

When things do turn around the builders will then be facing higher interest rates as keeping them this low is too expensive for the government in good times. It is going to be a rough path for the builders in the future.

This past week I was driving down South Oneida St and noticed that a new Green Bay Restaurant had just opened. This Green Bay Restaurant Greek Boy Gyros caught my eye right away. It was time to make the call to my sweetheart and meet her for lunch at a new Greek Gyro place in Green Bay Wisconsin. In Green Bay the only place that I’ve had amazing Gyro’s has been the Pancake Place on Military Avenue.

So as soon as we walked in we knew that Greek Boy Gyros was becoming quite a quick hit in Green Bay. There was people in line and the tables we’re packed. Typically that is a great sign and it was. Even though Greek Boy Gyros had a decent line they handled with ease. We decided to order the traditional Greek Gyro and we used a new coupon from an emerging leader in local Green Bay Deals from noofu.net.

We had our Gyro’s with five minutes of being there and we decided to dive right in. The cucumber sauce was amazing and instantly this place reminded me of Oakland Gyro’s in Milwaukee Wisconsin. If you’ve ever been to Oakland Gyro’s in Milwaukee WI you know how amazing there food is.

Being a Green Bay Wisconsin native I’ve had the opportunity to play all of the Green Bay Wisconsin Golf Courses that are available. Some people hunt, fish, play frisbee golf and other hobbies. My true passion is golf and I’m personally addicted to the sport and the opportunity to be outside and enjoy all of Green Bay’s beautiful views. Over the course of the next few months I’m going to personally bring you video tours of local Green Bay Golf Courses. The first Green Bay Golf course that I’ll be giving you a tour of is Thornberry Creek Golf Course in Green Bay WI.

Thornberry Creek Golf Course Green Bay WI

Just a short drive out of Green Bay you have an opportunity to play an extremely well maintained Green Bay golf course called Thornberry Creek Golf Course. Thornberry Creek Golf Course is embedded in one of the most popular luxury real estate areas in Green Bay Thornberry Creek Estates. The great thing about this amazing golf course is that it’s carved right into the beautiful Hobart area. You will apprecaite the amazing trees, wildlife, and holes that have gorgeous views of water.

How difficult is Thornberry Creek Golf Course ?

Thornberry Creek Golf Course has a 18 hole championship golf course and a 9 hole course as well. Lets start with the 18 hole championship course. For an amateur golfer that shots in the high 90′s this course will pose some amazing challenges such as heavily wooded trees that line the fairways on multiple holes, water that encompasses a real challenge for ball strikers without alot of accuracy. If you are conscious of losing golf balls be aware Thornberry Creek Golf Course is not for the faint of heart. I would strongly recommend you load on golf balls prior to entering the challenge that this Green Bay Golf Course will deliver.

However I really believe the views and the quality of this course outweigh the difficult for the golfer’s that don’t take it to serious. Shooting a good round at Thornberry Creek is possible but it takes alot of patience and playing really smart off the tee. If you enjoy letting the big dog eat off the tee box you’ll be in for some sore scores.

The 9 hole course is an additional option for local Green Bay Golfer to try their links skills. The 9 hole offers amazing holes and is quite a bit shorter which will play into a wide variety of golfers.

Is Thornberry Creek Golf Course a fun place to socialize?

One of the best traits of Thornberry Creek Golf Course is the clubhouse and the amenities that it offers. Thornberry Creek offers a wide variety of dining options to a casusal bar atmosphere to full dining and banquet hall options. The architecture and quality of the building is actually something to be viewed in awe. Since the new ownership food quality has improved in my opinion. Enjoying a cold refreshment after your round is a must.

In closing I would strongly recommend giving Thornberry Creek Golf Course in Hobart Wisconsin a shot. Look for coupons and special deals as they are out there. If you touring Green Bay and would like some company of a true Green Bay native and passionate golfer give me a call I’d be glad to tag along. You never know I might buy the first round.

The best way in my opinion to try all of their different Pizzas is to hit up their during the week lunch buffett. The price is extremely reasonable and the easiest way to get a taste of all they have to offer. Wanting to take the kids out for dinner somewhere different than your local McDonalds and Chuck E Cheese and want to support our local small business community then give Happy Joes in Green Bay a shot. I was able to take advantage of the Green Bay Neighborworks program and they assisted in me in additional closing cost money, and down payment assistance. So what’s the catch? Really theres not to much of a catch, other than you have to purchase a home in the Green Bay Impact Area. You have to participate in a Green Bay Homebuyer Education course, which I would strongly recommend even if you are not going to be using the program. Buying a Green Bay Home can be an intimidating process all the education you can get on the front end will make you feel a lot more comfortable. They also require that you get a home inspection which is always a must even if your not using the Green Bay Neighborworks program.

The U.S. Green Building Council is focused on taking the phrase of ‘green building’ out of the equation. I took this as a great step towards reducing our carbon footprint. Realty Times – Green-building Growing, More Jobs, More Buyer Interest

According to a new study from the U.S. Green Building Council (USGBC) and Booz Allen Hamilton, construction in the green-building industry will support 7.9 million jobs over the next four years while pumping into the American economy $554 billion. Currently, 2 million American jobs are supported by the same industry and more than $100 billion in gross domestic product and wages is generated.

The USGBC writes on its Web site that “buildings in the United States are responsible for 39 percent of CO2 emissions, 40 percent of energy consumption, 13 percent water consumption and 15 percent of Gross Domestic Product per year, making green building a source of significant economic and environmental opportunity.” The study found that from 2000 to 2008, $178 billion in gross domestic product was contributed to the economy and 2.4 million direct/indirect and induced jobs were created or saved which generated $123 billion in wages.

“Our goal is for the phrase ‘green building’ to become obsolete, by making all building and retrofits green — and transforming every job in our industry into a green job,” said Rick Fedrizzi, president, CEO and founding chairman of US Green Building Council.

What does the Green Bay School District have to offer?

Having grown up in Green Bay WI for the majority of my life I’ve had opportunities to be apart of the Green Bay School District. Throughout my youth I embraced all that the Green Bay School District had to offer. As a matter of fact it was a teacher at a local Green Bay Preble High School that gave me my first interest in Green Bay Real Estate. Today we’re going to look at what the Green Bay School District has to offer.

What does the Green Bay School District have to offer?

The Green Bay School District has started a Head Start + 4 Year-Old Kindergarten program
They offer a Gifted and Talented program that I can personally vouch for. The goal of the Gifted and Talented program is provide appropriate level of challenge so that they may continue to learn and grow.
The offer Grades PreK-12th Grade and have a total of 38 schools
Green Bay Schools offer strong music and drama departments
A major focus of Green Bay Schools is there athletics program
The English Language Learners program is currently helping a large portion of the Green Bay Student to learn English language skills.

My personal experience with the Green Bay School District

All the data above is all fine and dandy but it always helps to hear it from someone who’s been apart of the system. I attended elementary, middle school, and high school all throughout the Green Bay School District. The major thing that really sticks out to me when I think back to my school days is how involved all of the teachers in the Green Bay School District really were. From a very early age I had teachers who really seemed take interest in seeing me succeeded. The Green Bay School District offered me so many great learning options from culinary arts, orchestra, college prep classes and so much more. I owe them a large debt of gratitude for my success today.
